Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Coach Maximus mobile application (the "App") and any related services provided by Coach Maximus ("we," "our," or "us").

By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.

We reserve the right to update these Terms at any time. We will notify you of material changes via the App or by email at least 30 days before they take effect. Continued use of the App after such changes constitutes your acceptance of the updated Terms.

Use License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for your personal, non-commercial fitness purposes.

You may not:

Copy, modify, or distribute the App or any part of it
Reverse engineer, decompile, or disassemble the App
Use the App to build a competing product or service
Sell, sublicense, or otherwise transfer your rights to any third party
Remove any copyright, trademark, or proprietary notices from the App

Your Account

Certain features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or security breach.

You must provide accurate information when creating an account and keep it up to date. You may not create an account on behalf of another person without their authorization.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

Use the App in any way that violates applicable local, national, or international laws or regulations
Submit false, misleading, or fraudulent information (including inaccurate body or health data)
Attempt to gain unauthorized access to any part of the App or its infrastructure
Transmit any malware, spyware, or other malicious code
Interfere with or disrupt the integrity or performance of the App
Impersonate any person or entity

Violation of these rules may result in immediate suspension or termination of your access to the App without notice or refund.

Health and Fitness Disclaimer

Coach Maximus is not a medical service and does not provide medical advice, diagnosis, or treatment. The workout plans, nutrition targets, and guidance provided by the App are generated based on the information you supply and are intended for general fitness purposes only.

Before beginning any exercise or nutrition program — especially if you have a pre-existing medical condition, injury, or health concern — you should consult a qualified physician or healthcare professional. This is particularly important if you are pregnant, elderly, or have cardiovascular, metabolic, or musculoskeletal conditions.

Physical exercise and dietary changes carry inherent risks, including but not limited to muscle strain, joint injury, cardiovascular events, and other adverse health effects. By using the App, you voluntarily assume all such risks. Coach Maximus, its owners, and its team members are not liable for any injury, illness, property damage, or death that results from your use of the App or following any plan it generates.

Nothing in the App should be taken as a substitute for professional medical, nutritional, or physical therapy advice.

Subscription and Payments

Free Tier

Coach Maximus offers a free tier that includes access to the exercise library, personalized daily workout plans, nutrition macro targets, progress tracking, and offline access. No payment or credit card is required. Free-tier users may see advertisements served by Google AdMob.

Coach Maximus Pro

Pro is a paid subscription that unlocks additional features including unlimited exercise swaps, advanced progress insights, weekly email reports, meal-based nutrition mode, and an ad-free experience. The subscription price is displayed at the time of purchase and is subject to change with notice.

Subscriptions are purchased through and managed by the Apple App Store or Google Play Store, with subscription entitlements processed via RevenueCat. Billing, renewal, and cancellation are governed by the terms of the respective platform. We do not have access to your payment information.

Cancellation

You may cancel your Pro subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. You will retain Pro access until then. We do not provide refunds for partial subscription periods.

Refunds

All purchases are processed by Apple or Google and are subject to their respective refund policies. If you believe a charge was made in error, contact Apple or Google directly through their official support channels. We are unable to issue refunds directly.

Intellectual Property

All content within the App — including but not limited to exercise descriptions, workout logic, plan generation algorithms, user interface design, text, graphics, and software — is the exclusive property of Coach Maximus and is protected by copyright, trademark, and other intellectual property laws.

You are granted no rights to reproduce, redistribute, or commercially exploit any part of the App or its content without our prior written consent.

User-Generated Content

Data you enter into the App (body stats, workout logs, supplement logs, progress photos) remains yours. Progress photos are stored only on your device and are never transmitted to us. For any data you do share with us (e.g., feedback or support messages), you grant us a non-exclusive, worldwide license to use that content solely to provide and improve the App.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be error-free, uninterrupted, secure, or that any defects will be corrected. We do not warrant the accuracy or completeness of any workout plans or nutritional information provided by the App.

Limitation of Liability

To the maximum extent permitted by applicable law, Coach Maximus and its team members shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to personal injury, loss of data, loss of revenue, or loss of goodwill — arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims related to the App exceed the greater of: (a) the total amount you paid us in the twelve (12) months preceding the claim, or (b) $10 USD.

Indemnification

You agree to defend, indemnify, and hold harmless Coach Maximus and its team members from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third-party rights.

Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us at thecoachmaximus@gmail.com with a written description of the dispute and seek to resolve it informally. We will attempt to resolve the dispute within 30 days of receiving your notice.

If the dispute cannot be resolved informally, both parties agree to attempt resolution through binding arbitration before resorting to litigation, except where prohibited by applicable law. Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications outages, cyberattacks, or pandemics.

Termination

We may suspend or terminate your access to the App at any time, without prior notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the App ceases immediately. Locally stored data on your device will remain until you delete it.

You may stop using the App at any time by deleting it from your device. If you have a Pro subscription, cancel it separately through your App Store or Google Play account.

Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles. Any legal proceedings that cannot be resolved through the dispute resolution process set out above shall be brought exclusively in the courts of competent jurisdiction in Estonia. You consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via the App or by email at least 30 days before they take effect. The revised Terms will be effective when posted. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
